I saw this online for a number of years. It was advertized as a flare gun. I contacted the site host and asked about the gun. She said that her late husband brought it home with a bunch of civil war items. He said it was a flare gun and he listed it as a flare gun.
Here is how it was listed.
"Flare Gun. Black; silver. Iron; steel. This gun has a two-piece, cast iron handle and a steel barrel. It is marked, "Pat. July, Aug�." "

I cannot find patents or other records to tell me if it is a toy or whatever. Interestingly Signalman pointed out to me that there are 2 holes in the back of the grip that would possibly accommodate a skeleton stock. After two years I found the answer. It is Not a flare gun but it is an air gun!
It is one of the earliest models of the Daisy BB guns. It is actually the receiver for
a Daisy rifle circa 1890.

for saying whatever it is,
it likely had a skeleton stock. Most were just a metal skeleton, this one encloses a piece of wood.
